Plaintiffs allege that Defendant, Wines Til Sold Out (, relied on fraudulent pricing practices to make it seem as though their products were significantly discounted.  Defendant listed an "original price" as well as the new "discounted" price.  However, Plaintiffs allege that the "original price" was wholly artificial: designed to make consumers believe they were receiving a significant discount.  As a result of this pricing practice, consumers were lead to purchase products they would not have otherwise.

  1. Final Approval hearing set for March 19, 2018.
  2. Following the submission of objections and a Statement of Interest from the Department of Justice, the Court ordered the parties to submit additional support for Final Approval addressing:
    • "Whether the proposed settlement will require any class member to increase his/her/its typical wine bottle purchasing (based on historical purchasing patterns) in order to fully expend the Credits within the one-year Redemption Period
    • The United States' assertion (among others) that the claims in this case "lack a basis in consumer harm."

  2. Class counsel seeks a disproportionate share of the settlement.
    • Clear-sailing agreement and segregated fee fund are evidence of self-dealing.
  3. Class counsel has failed to prove their adequacy and the adequacy of the class representatives.
  4. Attorneys' fees are excessive and should be linked to the actual recovery by the class.
