Summary

Aurora Dairy Corporation sold organic milk under its own brand, as well as the in-house brands, for retailers including Publix, Costco, Safeway, Target, Wal-Mart, and Wild Oats Markets.  These products were sold at a premium, as coming from cows raised in a specific, organic, pastoral, humane, bucolic setting.  However, despite Aurora's production claims, the USDA disclosed in 2007 that their practices did not match their marketing claims and in fact, were largely in line with those of conventional milk producers.  The lawsuit seeks to compensate consumers for the premiums they unwittingly paid for a non-premium product.
