Lawsuit stems from a change in Wendy's practices regarding the use of trans fats in their cooking oils. In 2006, Wendy's launched a marketing campaign claiming that its breaded chicken products would have zero grams of trans fats and its french fries would have no more than 0.5 grams. Consumers were lead to purchase these products, believing that the lack of trans fats made them relatively healthier. However, independent testing by Consumer Reports, The Center for Science in the Public Interest, and plaintiff's counsel revealed that Wendy's fries contained significantly (up to 7 times) more trans fat than advertised.

  4. The Walsh Appeal was voluntarily dismissed on 10/26/2009.
