Summary

Lawsuit concerns the marketing practices of the Defendant (d/b/a Vogue International) for their Organix branded cosmetic products.  Consumers can reasonably assume, based on the name of the product line, as well as the marketing of the line, that the cosmetics are organic.  Consumers paid a premium for these products, based on these assumptions.  However, the Organix products were composed mainly of non-organic material.

  1. Final Approval granted.
  2. All objections were overruled.
  3. Objectors Hignite (through Attorney Scow), Cochran (through Attorney Cochran), and Morrison (through Attorney Kurilich) appealed the Final Approval.
  4. Class counsel motioned for an appeal bond of $12,890 from each objector.
  5. While the Court found that "the appeals appear to lack substantial merit or legal justification", it found that a bond is not the most appropriate means of weeding out frivolous appeals and denied the motion.
  6. All appeals were voluntarily dismissed.
