Plaintiffs allege that Defendant, BMW, sold convertibles with a known defect in the operation of the retractable roof.  This defect caused both operational problems and safety problems for consumers, who also had to pay out of pocket to have the issue resolved.

  5. The Sibley appeal was voluntarily withdrawn.
  6. The motion for appeal bond was then denied as moot.
