SoulCycle requires customers to purchase "certificates", which can then be redeemed for classes at their exercise studios.  Plaintiffs allege that these certificates have expiration dates well shorter than those required by law.  Customers who failed to redeem their certificates prior to the expiration date were forced to forfeit the remaining balance.  As a result of these impermissibly short expiration periods, SoulCycle was able to receive an improper windfall.

  1. Final Approval granted.
  2. All objections were overruled.
  3. Objector Sweeney appealed the Final Approval.
  4. Plaintiffs motioned for a $1,000 appeal bond, which was GRANTED by the Court.
  5. Objector Sweeney alleges that her failure to respond to Court notices is due to her email being compromised though, as the Court noted, all notices have been mailed (see Sweeney Letter, below).
  6. The Sweeney appeal was dismissed for failure to prosecute (failure to pay the filing fee).  Objector-Appellant Sweeney never posted the appeal bond.
