Plaintiffs allege that Defendant, Uber, sent unsolicited automated text messages to the cell phones of class members. These text messages were sent without prior express consent and were done in violation of the Telephone Consumer Protection Act (TCPA).

The Court overruled the Objection of Kerry Ann Sweeney, finding that "Sweeney and her family members are serial class action settlement objectors with a substantial history of filing objections that have been criticized and overruled by courts nationwide (see Order Overruling Sweeney Objection, pg 4-5)."
The Court also noted that, "Like other courts across the country, this Court declines to reward Sweeney for what is effectively a practice of objector blackmail: filing serial objections in attempt to extort money from class counsel without providing value (ibid, pg 5, emphasis added)"
Objector Sweeney appealed the Final Approval.
Plaintiffs motioned for, and were granted, an appeal bond of $5,000.
